The sanction for non-compliance with the provisions of the BDO Act may be a fine or arrest imposed by the courts and administrative fines imposed by the Voivodship Inspector for Environmental Protection.
Arrest or a fine may be imposed on a company that, despite the obligation: fails to submit an application for entry in the BDO Register, fails to submit an application to change the entry, fails to submit an application for deletion from the register, submits an application inconsistent with the facts, breaches reporting and recording obligations including, in the event of a failure of the BDO System, will not enter data from paper documents of waste records into this System, within the prescribed period. The fine that may be imposed by the court ranges from 100 PLN to over 1 million PLN.
An administrative fine is imposed for: running a business without the required entry in the BDO Register, failing to include the registration number, assigned upon registration in the BDO Register, on documents drawn up in connection with the business activity. The administrative fine ranges from 5000 PLN to 1 million PLN.
From January 1, 2020, a fine or arrest will also be imposed on anyone who does not keep, provide or submit documents and any data required by the Act for a specified period of time, and who, during the transport of waste and municipal waste, does not have confirmation generated from BDO.
